Penalties for the business: The IRS aggressively enforces employment trust fund taxes. In addition to recovering the amount of overdue taxes, the IRS may assess interest and a trust fund recovery fee. In order to satisfy delinquent tax debt, penalties, and fees, the IRS may levy bank accounts or receivables, or seize vehicles or other company property. The IRS can essentially shut down a business - stopping all revenue and adding to the financial problems of the business.

Penalties for responsible parties: In addition, the IRS will seek out the persons responsible for submitting payment to the IRS. The responsible person for submitting payment to the IRS may be held personally liable for the delinquent employment taxes - resulting in personal bank account levies, vehicle seizure, and assessment of personal penalties. These penalties are equal to the amount of taxes owed (including interest) and cannot be discharged in bankruptcy.
