Federal Criminal Appeals Attorney In Georgia
The jury's verdict in a criminal trial is not the final word. If errors occurred during your trial, you potentially can appeal. If you have been convicted in Federal Courts, there are strict timelines for requesting an appeal. It is important to contact an experienced federal criminal defense lawyer right away to review your trial case and determine if you have valid grounds to begin an appeal.
An appeal is your last chance for seeking relief from criminal charges. Don't entrust your future in the hands of an inexperienced appeals lawyer. At the law office of Richard Grossman, I know the intricacies of the federal appellate courts and the mandatory sentencing guidelines. I use my decade of experience to fight for my client's rights and freedom. Contact my Atlanta law office at 678-358-6555 for a free initial consultation.
Seeking Post Conviction Relief in Federal Criminal Appeals
The federal sentencing regime is complex; federal sentencing guidelines contain what used to be mandatory sentences, but since the Supreme Court's decision in Booker, those guidelines are now considered advisory. However, interpreting just how "advisory" they may be requires an understanding recent Supreme Court and Eleventh Circuit jurisprudence. If you are convicted for a federal crime, you will face a potentially minimum sentence as determined by the federal sentencing guidelines.
However, there are options for post conviction relief. As an experienced federal criminal appeals lawyer, I know how to present my client's position upon appeal. I draft effective appellate briefs on the legal issues involved, present persuasive oral arguments before the appeals board, and do everything in my power to assert my client's rights.
By proving errors were made at the criminal trial court level, the judgment may be overturned, reversed, or remanded back to the trial court. Even if there is enough evidence for a conviction, a new fair trial may result in a different outcome.
For example, if drugs that were confiscated illegally were permitted as evidence in the initial trial but the evidence is deemed inadmissible upon appeal, the case may lack sufficient evidence to obtain a conviction. Or, there may be insufficient evidence for such serious charges. Federal drug trafficking charges may be reduced to drug possession. Reduced charges may result in reduced sentence under the sentencing guidelines.
