Crack Amendment

The Sentencing Commission has revised the Federal Sentencing Guidelines to reduce the disparity between sentences imposed for crack cocaine and powder cocaine. The Sentencing Commission reduced the guideline range for crack cocaine by two levels for most cases. On December 11, 2007, the Sentencing Commission voted to make the crack amendment retroactive to all defendants, including those who were sentenced before the amendment took effect on November 1, 2007.

What Does The Revision Of The Crack Amendment Mean For You?

If you were sentenced under the federal sentencing guidelines and your guideline range was based on crack cocaine, you may be eligible to have your sentence reduced! The law allows you to ask a judge reduce you sentence if the Sentencing Commission lowers your guideline sentencing range after you are sentenced. It has been estimated that the average reduction for crack based sentences is about 15 months.
